Inevitably your job is a major part of your life. When problems arise at work it can be financially and emotionally distressing.
We are ready with support and advice to guide you through the maze of employment law.
We can advise on:
Redundancy is probably the most common reason given by employers to justify a dismissal.
Redundancy occurs due to the closure of a workplace, or where the employer no longer needs employees or as many employees to do a particular kind of work.
If you have been employed for two years you will be entitled to a redundancy payment if your employment has been terminated by reason of redundancy.
In some circumstances you may also have a claim against your employer for unfair dismissal. This can arise if the employer has not properly consulted with employees or has operated an unfair selection process.
If you have been made redundant, we can advise you whether you have received your correct settlement and the options that you have.
If you feel at risk of redundancy we can provide advice on your rights and entitlements.
When a working relationship is terminated, many employers ask employees to sign a settlement agreement which will set out the terms on which the employment ends.
Without independent legal advice these agreements are not valid, as they would not prevent you from bringing a claim against your employer for unfair dismissal or discrimination.
Employers therefore generally pay for the cost of independent legal advice so that they can draw a line under any potential employment claims you may have.
We can advise you on a wide variety of settlement agreements, from the most straightforward to those which are more complicated and involve restrictive covenants, tax indemnities and confidentiality issues. We negotiate on your behalf to achieve the best possible outcome.
If you are involved in disciplinary proceedings at work it is important that you are aware of your rights and obligations.
Facing a disciplinary meeting is very stressful and if the allegations are upheld, the outcome can range from an initial informal warning to summary dismissal.
We can advise you on your rights, and on tactical considerations which may assist you in the process and the options open to you.
